Amendment to PD 278

The applicant is requesting to amend the 5-foot side yard setback on lots 1-6, 9-13, and the 5-foot corner side yard setback on lots 7 & 8 established in Planned Development 278. Specifically, the request will reduce the 5-foot side and corner side yard setbacks to 4-feet on all lots in the subdivision. All other setbacks established in PD 278 would remain the same. Appeal of undergrounding utilities on MDP 21-08

Minor Discretionary Permit 2021-08 was issued on August 13, 2021 authoring the development of the 12-acre parcel at 1525 West Monte Vista Avenue (Stanislaus County APN 071-004-009) with a 348-unit multi-family residential project. Condition #26 of the Minor Discretionary Permit required the project to comply with Turlock Municipal Code Section 9-2-120 which requires overhead utilities lines be installed underground. TMC 9-2-120 allows applicants to request a waiver from the requirement and is contingent upon approval by the City Engineer. The applicant requested a waiver from the requirement to underground the existing overhead utility lines along N. Walnut Road because undergrounding the utility lines would require the applicant to bore under N. Walnut Road. The City Engineer denied the waiver request. The item going before the Planning Commission is the applicant’s appeal of the City Engineer’s denial of the waiver request. If the denial of the waiver is upheld the project will be required to install the existing overhead utility lines underground. If the waiver is approved, then the existing overhead utility lines and associated utility poles will remain overhead along N. Walnut Road. CEQA DETERMINATION: Pursuant to CEQA Guidelines Section 15162(b), no changes in the project have been made, no changes have occurred in the circumstances under which the project is to be undertaken, and no new information has become available after the adoption of the Mitigated Negative Declaration on August 13, 2021, that would require preparation of a subsequent negative declaration or environmental impact report as required under Section 15162(a) of the CEQA Guidelines.

MDP 2022-04 Tegner Townhouses

The applicant is proposing to develop a 1.74-acre parcel with a 31-unit multi-family residential project at 4118 N. Tegner Road (Stanislaus County APN: 087-026-001). The project will construct a total of seven three-story townhouse style buildings approximately 30’ in height. Each townhouse unit includes a patio or balcony area and garage or carport. Seven of the townhouse buildings include roof top terraces and additional guest parking spaces are included within the property. The townhouse buildings along Tegner and Sandstone are setback approximately 20’ from the front property lines similar to the setbacks of the homes in the surrounding residential neighborhood. Driveway entrances on Tegner and Sandstone provide access throughout the townhouse project. Off-site frontage improvements, including, curb, gutter and sidewalk will be installed along the Tegner and Sandstone frontages.This project is “Categorically Exempt” from the provisions of the California Environmental Quality Act (CEQA) Section §15332 [In-Fill Development Projects].
